TERMS & CONDITIONS:

Upon booking a tour, or any other product presented in this brochure or website, you acknowledge and accept to be bound by and comply with the terms and conditions mentioned herein. BYOTA Inc. may change these terms and conditions, at its sole discretion, occasionally, and you agree to be bound by and comply with such terms and conditions as they may be modified. All prices are quoted in Canadian dollars, unless otherwise specified. The prices are based on tariffs and currency exchange in effect as of Dec 31 2015. All prices are subject to adjustment in the event of changes to the tariffs and exchange rates.

 

MAKING A BOOKING

BYOTA Inc. accepts bookings through travel agents. All communication regarding the tours as well as all payments and/or refunds are to be conducted through your travel agent. A deposit, payable by cheque, money order, credit card (Visa, MasterCard or Diners Club) is required at the time of booking. Your authorization to use your credit card for deposit and/or final payment indicates your compliance with

our booking terms and conditions, whether or not you have actually signed the appropriate draft. Faxed, emailed or verbal authorization of your credit card confirms your reservation. Final payment is due 45 days prior to departure. Reservations made within 45 days of commencement must be accompanied by full payment. BYOTA Inc. will forward written confirmation and preliminary travel information upon

receipt of deposit. Travel documents will be sent 2-3 weeks before departure upon receipt of full payment.

 

DEPOSIT AMOUNT

Tours/Packages $300 per person

Hotels Full payment at time of booking

Car Rental $50 per car

 

PAYMENT

Payment must be made through your travel agent. Accepted methods of payment: Visa, Mastercard, Diners Club and Cheques. BYOTA Inc. will appear as vendor on your statement. The travel agent is responsible for retaining a signature on file.Verbal authorization to process your credit card acquired by your travel agent indicates your compliance with terms and conditions presented herein. In case of a refusal to honour the charge, the travel agent is responsible for the full amount. BYOTA Inc. reserves the right to cancel bookings if the payment has not been received within 5 days of the booking.

 

CANCELLATION PENALTIES:

Cancellations must be made in writing.

• TOURS/PACKAGES

- Up to 45 days prior to departure - $300.00 (deposit)

- 44-35 days prior to departure - 50% of the tour cost

- 34 days or less prior to departure - 100% of the tour cost

• HOTELS

- Up to 21 days prior to departure - $50 per person

- 21-14 days prior to departure - 50% of the total cost p.p.

- 14 days or less prior to departure - 100% of the total cost p.p.

• CAR RENTAL

- Up to 5 days prior to departure - $50.00 (deposit)

- 5 days or less prior to departure or no show - $50 plus two days’ rental cost.

• AIR

Cancellations or revisions vary according to the rules and policies deemed by the specific airlines, and will be presented accordingly.

 

BOOKING MODIFICATIONS

BYOTA Inc. will make every effort to accommodate requests changes to bookings. The following fees apply:

• TOURS/PACKAGES

- Up to 21 days prior to departure - $75.

No changes are possible in less than 21 days prior to departure

• HOTELS

- Up to 14 days prior to departure - $50 per person. Any changes less than 14 days prior will be considered as a cancellation and

cancellation fees apply.

• CAR RENTAL

- Up to 5 days prior to departure - $50.00. Any changes less than 5 days prior will be considered as a cancellation and cancellation fees apply.

 

TRAVEL INSURANCE

We highly recommend purchasing Travel Insurance at the time of booking. Please contact your travel agent to purchase travel Insurance.

 

REFUNDS

No refund can be made for unused portions of the tour, including but not limited to missed meals or sightseeing. If you must withdraw from the tour for reasons such as illness, be sure to obtain a medical certificate in support of any insurance claim. If, for any reason, BYOTA Inc. cancels the tour, your money will be fully refunded, in which case

BYOTA Inc. has no further obligation.

 

DOCUMENTS

Your travel agent will receive the travel documents no later than 14 days prior to departure. It is the tour participant's responsibility to obtain, at his/her expense, all documentation required by the relevant government authorities, including those for your return to Canada. Ask your travel agent for more details.

  assumes no responsibility for any delay, loss or extra expense incurred as a result of improper or lack of travel documents.

 

TIMETABLE DEVIATIONS

Each passenger will have options and opportunity to deviate from the tour return date. Air deviations will be subject to availability and must be requested prior to departure from Canada or the USA. Air deviations will involve an additional cost.

 

ITINERARY VARIATIONS

Slight changes in the day-by-day itinerary may occur due to local conditions and or unexpected operational difficulties beyond our control. Also, should it be necessary, local suppliers reserve the right to substitute tours, performances, meals, etc., with those of equal or greater value, with no further obligation.

 

EXCHANGE RATES

Due to recent fluctuation in exchange rates, prices cannot be guaranteed until payment is received in full. This guarantee excludes fuel surcharges and does not apply to any taxes, charges or levies imposed by any government or their agencies. In exchange for this guarantee, no refund will be made if costs are reduced. Prices are per person and in Canadian Dollars unless otherwise specified.

 

STANDARDS

Travelers should be aware that different living standards and practices and different standards and conditions with respect to the provision of utilities, services and accommodation might exist outside Canada and the USA.

Hotel ratings are not based on North American standards; therefore, they cannot be compared to ours judged by our domestic standards. BYOTA Inc. will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that BYOTA Inc. will use every precaution to ensure that adequate measures are taken. )

 

HOLIDAYS

During local or national holidays, certain facilities such as museums, attractions, restaurants, sightseeing tours and even shopping may be limited or not available. Alternatives will be offered whenever possible.

 

SERVICES NOT INCLUDED IN TOUR PRICES

Cost of passports, excess baggage charges, additional insurance, porterage, unless otherwise indicated in the itinerary, personal items such as laundry, cable telephone calls, room service, additional beverage service, meals and transfers not included in the tour, tips to the motor coach driver and local guides, which is subject to your satisfaction with their services; any items not specifically mentioned as included. If necessary, vaccinations are at your expense

 

SPECIAL ASSISTANCE

You are required to report any disability requiring special attention to BYOTA Inc. at the time of reservation so we can make all reasonable attempts to accommodate the special needs of disabled travelers. In the event of not being able to do so, BYOTA Inc. is not responsible for any denial of services by carriers, hotels, restaurants and other independent suppliers. Most transportation services including the touring motor coach are not equipped with wheelchair ramps. We cannot provide individual assistance to a tour participant for mobility, dining, or other personal needs.

 

RESPONSIBILITY

BYOTA Inc., 795 rue Main Street, Suite 300, Moncton, New Brunswick, Canada 1-855-242-0856, makes arrangements with reputable suppliers and acts only as an agent for the airlines or contractors providing accommodation, transportation, meals or other services, and accepts no responsibility for the quality of services in hotels, on board aircraft or any vehicle used in connection with the trip, nor for delays, loss or damage of luggage, or accident incurred by passengers resulting from the use of these transportation means, whatever the cause. Also, BYOTA Inc. shall not be liable for losses or additional expenses due to customer being late for a service. BYOTA Inc. is not liable or responsible for any loss, injury or damage to person, property or otherwise in connection with any transportation, accommodation, meals, tour or other services referred to herein, or resulting form neglect or default of any person harmed, corporation or other entity engaged to supply the same.

 

PRICE INCREASES

All advertised prices are calculated using fixed costs at the time of publication. These costs are dependent on many variables(rate of exchange, fuel costs, etc). Should these prices change. BYOTA Inc. reserves the right to increase its price. If the price increase is greater than 7%, the consumer has the right to cancel the contract for travel services and be refunded the full amount paid for these services unless the increase is a result of Government imposed taxes or fuel surcharges approved by the Canadian Transportation Agency. BYOTA Inc. respects the privacy of our customers. We will never release your personal information (email, address, etc.) to any outside agency. Any information provided to BYOTA Inc. & our products will be held in the strictest confidence. We may from time to time, with your permission, send you information we feel will be of use to you in planning your client’s dream vacation.
